You should always use the most up to date gear in order to maximize your stats in the competitive PvP environment, but in TBC the difference in stats from season to season is not crazy high so if you are skilled it should be possible to compete even with old gear, yeah.

I was referring to whether the PVP S2 items (merciless and non-set items) are viable to make PVE content of T4 and T5 or on the contrary the pieces that you get in this content are more viable for druid bear tank.

Ah I see, in that case I'd always go with the PvE gear if T5 since that is equivalent to S2 PvP items but with 0 stats wasted on Resilience, while T4 gear will be about equivalent / slightly worse in some slots (such as weapon) than PvP S2 gear.
